This was an invited paper presented at the Global Network for the Study of Human Rights and the Environment Workshop entitled ‘Human Rights and the Environment: In Search of a New Relationship’ at the Onati International Institute for the Sociology of Law, Spain, June 2012.

The paper traces India’s green jurisprudence as an outcome of a proactive Supreme Court through public interest litigation. The paper argues that public interest litigation is not a ‘magic bullet’ and two case studies illustrate its limitation.
