This contribution was drafted within the framework of a European project on mediation. Its main aim was to state the law as it stands in France in 2012 following the major changes brought in by the implementation of Directive 2008/52/EC of the European Parliament and of the Council of 21.5.2008 on certain aspects of mediation in civil and commercial matters. The Directive was implemented in France in late November 2011 and early 2012, making this article very topical. The article also critically analyses this implementation.
