From an institutional, sociological and comparative perspective, the supposed neutrality of the legal status of the interpretative communications of the European Commission, and the interaction and mutual influences of national and EU administrative principles, reveal the existence of a new political paradigm of unforeseen consequences. The comprehension of this paradigm requires not only a more complex examination of the hard law / soft law interface, but a renewed analysis of differing levels of soft law, within and between, administrative, judicial and jurisdictional national and supranational levels, subsequently challenging the received perception of the EU bureaucratic normative order.
