English abstract

The Human Rights Committee requires a more rigorous implementation of the right to a fair trial in criminal cases where capital punishment may be imposed than in other trials where the potential penalty is less grave. The Committee has also established that infringement of the fair trial rule constitutes an infringement of the right to life itself when a sentence of death has been pronounced. Since the right to life belongs to the intangible rights, the right to a fair trial becomes itself intangible, when one is liable to the death penalty.
