This chapter shows that in order to understand Franz Neumann’s celebrated work on the rule of law, we must take account of the character of his particular engagement with the ideas of Max Weber and Carl Schmitt. It then focuses on his idea of the ‘economic’ constitution, which provides the foundation for a social-democratic alternative to both liberalism and conservative-authoritarian attacks on the modern Rechtsstaat. Neumann’s work was also fundamental to the development of the political theory of the Frankfurt School, and exploring these connections provides insights into his celebrated analysis of both Nazi Germany and political freedom.
