This article extends the theorising in the Minority Ethnic Exclusions and the Race Relations (Amendment) Act 2000, research, questioning the utility of the notion of ‘institutional racism’. It proposes the concept of ‘passive racism’, which has three levels of severity. It postulates that the application of this concept would have greater leverage in generating preventative action in schools, local authorities and the education establishment in addressing the recurrent, routine and damaging inequality in ethnic minority school exclusions.
