The article develops, qualifies and criticises the introductory case about a German constitution made in the sub-section on 'Constituting Germany' (pp. 38-47) in Chapter 1 of Nationalism in Germany, 1848-1866. There is no significant overlap between the book and the article. A limited number of quotations from primary sources, which were needed in order to present the introductory argument of the article, also appear in the book.
