FMStG - Finanzmarktstabilisierungsgesetz : Kommentar
In October 2008 German Parliament rapidly and fairly secretly passed a highly complex statute to stabilise the financial markets (“Finanzmarktstabilisierungsgesetz”). The German legislature felt it had to act to prevent the imminent breakdown of the German economy. The statute not only invented a number of stabilising financial mechanisms, but also created a powerful public authority making and implementing decisions. Due to a lack of legislative preparation the statute entails significant theoretical problems. The book aims to analyse structure and content of the statute in the context of constitutional law as well as the law of the European Union.
