A significant contribution on the subject given the NSW Legislative Council Select Committee's recent recommendations for reform to the law on provocation. The article highlights flaws in the proposed exclusionary conduct model citing problems experienced in England and Wales in relation to s.54-56 of the Coroners and Justice Act 2009. An important distinction is made between exclusionary models which focus on the defendant's conduct (for example, becoming voluntarily intoxicated) as opposed to the actions of the victim.
