English abstract

Can the very idea of human rights and the freedom of states to resort to capital punishment be reconciled? Although it may seem contradictory, international human rights law does not prohibit the death penalty as such. At best, international law has introduced limitations in the way executions can be carried out. In parallel international organisations such as the Council of Europe and the United Nations have embraced controversial abolitionist agendas. The book explores this tension and gives an overview of the international legal issues raised by what remains one of the most debated questions at the international level.
