After discussing the introduction of reformed Observance in the Mendicant orders as a context for its adoption by the Dominicans of Fiesole (Florence), this paper analyses the problems of reform among the Italian Dominicans. It focuses on the legal opinion (consilium) prepared in 1397 for the Dominicans of Padua, who risked expulsion. The judgement was, predictably, in favour of a more rigorous observance of current practice, not a return to origins. The paper therefore articulates the extent and quality of the arguments and of recourse to early legislation, custom, social norms, 'utilitas' and (more remarkably), to urban legislation.
