Untangling Sexual Consent

This article surveys the terrain of thinking about sexual consent within the legal-analytical tradition and identifies key weaknesses in how this approach deals with issues of context, social discourse, bodies of knowledge and structure, and consent as a process of power relations and engagements rather than a single act or utterance. It identifies two sets of contested focuses – the sexual agent who consents or withholds consent, and the cultural and communicative context that influences and frames consent decisions. Sexual ethics has to look beyond this focus on consent to address these issues.
