Advice for the courts? Sufficiently reliable assistance with forensic science and medicine (Part 2)
In response to problems with unreliable forensic science evidence and the Law Commission’s Expert Evidence in Criminal Proceedings report (discussed in Part 1), this article considers a procedure designed to assist courts with their responses to expert evidence and engagement with scientists and scientific knowledge (from beyond the courtroom). The article advocates the formation of a multidisciplinary advisory panel to independent provide short reviews that might be used by lawyers and judges in their decision-making around the use and assessment of expert evidence, especially emerging technologies.
