English abstract

In its fight against international terrorism, the UN Security Council has adopted coercive measures against Osama bin Laden, the members of the Al-Qaida organisation and the Taliban. The nature of those measures and the procedure for their imposition systematically undermine three human rights. Those rights do not form part of the ius cogens to be respected by the Security Council but the latter is also bound to comply with the human rights enshrined in the principal UN instruments for the protection of human rights and in customary law, unless to do so would be incompatible with its peace-keeping action.
